Alina Habba has resigned as New Jersey's top federal prosecutor. This comes after a legal ruling that questioned her eligibility to hold the office.

Acceptance of Resignation

US Attorney General, Pam Bondi, confirmed her stepping down on the start of the week. Bondi stated that the appeals court finding made it impossible for her to effectively run her office.

"But do not mistake compliance for surrender," Habba stated. "The effort will now reach across the country."

Judicial Challenge

Her resignation comes a week after a US appeals court determined that she had been serving in violation of the law as the federal prosecutor. This ruling is expected to impact numerous legal proceedings in New Jersey.

The appellate judges declared that a interim role that bypassed the advice and consent of the Senate ran afoul of the statute on vacant positions.

Future Role and Reaction

It was also stated that Habba will continue working within the DOJ as a top consultant. They intend to challenge the decision of the ruling, aiming for a different outcome.

On a social media platform, Bondi contended that judges "cannot be permitted to countermand the President's choice of attorneys entrusted with carrying out the primary duty of the administration of criminal prosecution."

She praised Habba's record and said that while she was in charge, the Newark saw a 20% reduction in offenses. She also stated that the city of Camden recorded its first summer in 50 years with no murders.

Background and Previous Role

Habba, originally became part of Donald Trump's lawyers in 2021. Subsequently, she acted for her client in his hush-money trial in 2024, leading to his guilty verdict on dozens of charges of financial record manipulation.

Prior to Habba took on the role of US Attorney, the former president had stated he was appointing her as his presidential counsellor in a potential future term, calling Habba as deeply loyal and a dedicated fighter for justice.
